Detailed Pixels provides website design, development, maintenance, and related digital services, including but not limited to:

Website Care maintenance subscriptions

Website updates and technical support
All services are subject to the specific proposal, estimate, invoice, or written agreement provided to the client.
2. CLIENT RESPONSIBILITIES
To ensure successful project completion, you agree to:

Provide accurate and complete information

Supply necessary content (text, images, branding assets) promptly

Respond to communications and approval requests within a reasonable timeframe

Ensure you have legal rights to all materials you provide
You remain solely responsible for the legality, accuracy, and ownership of all content submitted to Detailed Pixels.
3. PAYMENTS & BILLING
Payment terms are outlined in each project proposal, estimate, invoice, or service agreement.

Deposits must be paid in full before work begins.

Final payment is due upon project completion unless otherwise agreed in writing.

Website Care subscriptions ("WebHost+Care™") are billed according to the selected plan.

Late or unpaid invoices may result in suspension of services, or delay in deliverables, until payment is received.

All fees are stated in U.S. Dollars unless otherwise specified.
Detailed Pixels reserves the right to suspend or terminate services for overdue accounts.
4. REVISIONS & SCOPE
Project proposals define the scope of work included with each project.
Reasonable revisions are included as specified in your proposal. Requests outside the agreed project scope, or additional revisions beyond those included, may require additional fees.
Changes requested after project approval may require revised timelines and pricing.
5. INTELLECTUAL PROPERTY
Client content remains the property of the client.
Until full payment is received:

Detailed Pixels retains ownership of all website designs, source files, and related materials.

Limited previews may be provided for review purposes.
Upon receipt of full payment:

Ownership of the completed website design transfers to the client unless otherwise agreed in writing.

Detailed Pixels retains the right to display completed work in its portfolio, website, and marketing materials unless otherwise agreed.
Third-party software, themes, plugins, fonts, hosting platforms, and licensed assets remain subject to their respective licenses.
6. HOSTING & THIRD-PARTY SERVICES
We may utilize third-party providers for website hosting, analytics, payment processing, domain registration, security, email delivery, or related services.
Detailed Pixels is not responsible for outages, pricing changes, policy changes, or service interruptions caused by third-party providers.
7. DISCLAIMERS
All services are provided "as is" and "as available."
While we strive to provide reliable services, we do not guarantee:

Continuous or uninterrupted website availability

Specific search engine rankings or SEO performance
-
Error-free operation of third-party platforms or services
-
Compatibility with every browser or device indefinitely
Internet technologies continually evolve, and occasional updates or maintenance may be necessary.
8. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Detailed Pixels shall not be liable for:

Indirect, incidental, consequential, or special damages

Loss of profits, business opportunities, goodwill, or data

Damages arising from third-party products or services
Our total liability shall not exceed the total amount paid by the client for the specific services giving rise to the claim.
9. TERMINATION
We reserve the right to suspend or terminate services if:

Payment obligations are not met

These Terms are materially violated

Fraudulent, abusive, or unlawful activity occurs

Continued service becomes impractical or impossible
Termination does not relieve either party of outstanding payment obligations.
10. FORCE MAJEURE
Detailed Pixels shall not be responsible for delays or failures resulting from circumstances beyond our reasonable control, including natural disasters, internet outages, labor disputes, governmental actions, cyberattacks, or failures of third-party service providers.
11. PRIVACY
Your use of our Site is also governed by our Privacy Policy, which explains how we collect, use, and safeguard your information.
12. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
Any legal action relating to these Terms shall be brought exclusively in the state or federal courts located in Orange County, California.
13. ENTIRE AGREEMENT
These Terms, together with any written proposal, estimate, invoice, service agreement, or statement of work, constitute the entire agreement between the client and Detailed Pixels regarding the services provided.
14. SEVERABILITY
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
15. WAIVER
Failure by Detailed Pixels to enforce any provision of these Terms shall not constitute a waiver of that provision or any other rights.
16. CHANGES TO THESE TERMS
We may revise these Terms at any time. Updates will be posted on this page with a revised "Last Updated" date. Continued use of our Site or services after changes constitutes acceptance of the revised Terms.

18. SUBSCRIPTION CANCELLATION POLICY
Website Care subscriptions may be cancelled by providing at least three (3) days' written notice before the next scheduled billing date.
Subscription fees already paid for the current billing period are non-refundable.
One-time project deposits are non-refundable once work has commenced.
Cancellation of recurring services does not affect outstanding balances for services already rendered.
