Detailed Pixels provides website design, development, maintenance, and related digital services (the “Services”). Services may be offered as:

  • One-time project-based work

  • Ongoing subscription-based services

  • Custom agreements tailored to client needs

 

All Services are subject to the specific terms outlined in individual client agreements, proposals, or invoices.

2. CLIENT RESPONSIBILITIES

To ensure successful project completion, you agree to:

  • Provide accurate and complete information

  • Supply necessary content (text, images, branding assets) in a timely manner

  • Respond to communications and approvals promptly

  • Ensure you have legal rights to all materials you provide

 

You are solely responsible for the legality, accuracy, and ownership of all content submitted to us.

3. PAYMENTS & BILLING

By submitting this form, you agree to our Privacy Policy and consent to being contacted regarding your inquiry.

4. REVISIONS & SCOPE

Projects include a reasonable number of revisions as defined in your agreement. Additional revisions or work outside the agreed scope may result in additional charges.

Scope creep is like glitter, it spreads everywhere if you don’t contain it. We contain it with clear boundaries.

5. INTELLECTUAL PROPERTY

Client Content

You retain ownership of all content you provide.

Completed Work

Upon full payment:

  • You are granted rights to the final website design and deliverables

  • We reserve the right to showcase completed work in our portfolio unless otherwise agreed

Third-Party Tools

Websites may incorporate third-party tools, themes, plugins, or platforms (e.g., Wix). These remain subject to their own licenses and terms.

6. HOSTING & THIRD-PARTY SERVICES

We may utilize third-party providers for hosting, analytics, or integrations, including but not limited to:

  • Cloudflare (performance and security)

  • Google Analytics

  • Payment processors and form services

We are not responsible for outages, errors, or policy changes from third-party services.

7. DISCLAIMERS

All Services are provided “as is” and “as available.”

We do not guarantee:

  • Specific business results (leads, revenue, SEO rankings)

  • Uninterrupted or error-free website operation

  • Compatibility with all browsers or devices indefinitely

The internet is a living organism. Things change. We adapt, but we don’t control the entire ecosystem

8. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Detailed Pixels shall not be liable for:

  • Indirect, incidental, or consequential damages

  • Loss of profits, data, or business opportunities

  • Issues arising from third-party platforms or services

Our total liability shall not exceed the amount paid to us for the specific Service giving rise to the claim.

9. TERMINATION

We reserve the right to suspend or terminate Services if:

  • Payments are not made

  • Terms are violated

  • Communication breaks down to the point of project infeasibility

You may terminate Services at any time, but no refunds will be issued for work already completed or active billing periods.

10. INDEMNIFICATION

You agree to indemnify and hold harmless Detailed Pixels from any claims, damages, or legal actions resulting from:

  • Content you provide

  • Misuse of the website

  • Violation of laws or third-party rights

11. PRIVACY

Your use of our Site is also governed by our Privacy Policy. Please review it to understand how we collect and use your information.

12. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.

13. CHANGES TO TERMS

Continued use of the Site after changes constitutes acceptance of the updated Terms.

15. SUBSCRIPTION CANCELLATION POLICY

  • Clients may cancel by notifying us at least 3 days before the next recurring monthly charge is scheduled/due. 

  • Websites may be taken offline upon cancellation if tied to our hosting or platform if proper transfer arrangements/information has not been supplied.

  • Reinstatement may require setup fees.

  • For a comprehensive understanding of the terms associated with your recurring "WebHostCare+" Subscription, please refer to the specific terms outlined within your WebHostCare+ contract.
